The six-to-three order, handed down on Thursday, grants a request by the state to lift a federal judge's block that had struck down the redistricting plan in November.

Court's Rationale

The federal judge improperly inserted itself into an active primary campaign, creating significant confusion and upsetting the sensitive federal-state balance in elections, the order stated in detailing its ruling.

The federal court had previously found that Texas had likely classified voters by their race – a practice known as unconstitutional racial sorting – when it adopted the boundaries. It had ordered the state to revert to the boundaries drawn after the most recent national count for the upcoming election.

Strong Opposition

In a forcefully written objection, Justice Elena Kagan criticized the majority's action. She stated that it disregarded the work of the district court, noting that its opinion was crafted by a judge appointed by former President Donald Trump.

Our position is above the district court, but our capability is not greater for resolving such fact-driven issues, Kagan argued in a dissent co-signed by Justices Sonia Sotomayor and Ketanji Brown Jackson.

The justice went on, This court's stay guarantees that Texas's new map, with all its increased political tilt, will govern next year's elections. And it means that many Texas residents, unjustly, will be placed in electoral districts because of their race. And that result, as this court has stated repeatedly, is a infraction of the constitution.

National Redistricting Battle
