US Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the court pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
